Partner Visa

If you are married, or in a de facto relationship with an Australian Citizen, Australian Permanent resident or an eligible New Zealand Citizen then you are eligible for the partner visa.

What are the different types of partner visa?

The Partner visa that you apply for will depend on your particular circumstances.

The visa options are:

Partner Temporary visa (subclass 820) and Partner Permanent visa (subclass 801) – Onshore application

The partner visa is for an onshore temporary partner visa application. It is a two stage process to permanent residency.

The first step is the grant of the Temporary Partner visa (subclass 820). During this stage the applicant will be able to work in Australia and have access to Medicare.

The second step is the grant of the onshore permanent visa (subclass 801)

The second step of the visa occurs two years after the date the application was lodged. This step grants the partner permanent residency to stay in Australia indefinitely.

Partner (Provisional) visa (subclass 309) and Partner (Migrant) visa (subclass 100) – Offshore application

The partner visa is for an offshore temporary partner visa application. It is a two stage process to permanent residency.

The first step is the grant of the offshore Temporary Partner visa (subclass 820). During this stage the applicant will be able to enter Australia, work in Australia and have access to Medicare.

The second step is the grant of the offshore permanent visa (subclass 801)

The second step of the visa occurs two years after the date the application was lodged. This step grants the partner permanent residency to stay in Australia indefinitely. As this visa was applied offshore, the applicant needs to travel outside Australia for the grant of the visa.

Prospective Marriage Visa (subclass 300)

The Prospective Marriage visa is for people that want to come to Australia and marry their prospective spouse who is an Australian Citizen, Australian permanent resident or an eligible New Zealand Citizen.

The prospective marriage visa is a three stage process to permanent residency. Steps 2 and 3 are similar to the partner application 820/801.

The first step is the application for the Prospective Marriage Visa (subclass 300). This visa is valid for 9 months, once you have married your finance during this time, you can then apply for the Temporary Partner Visa.

It is important to note that if you apply for prospective marriage visa, the costs of the application to permanent residency is roughly the same for those that apply for the 820.801 visa. The reason is the Department of immigration charges a lower fee if you a holder of a subclass 300 visa.

What are the general requirements for the partner visa?

  • The applicant is 18 years of age
  • You and your partner genuinely intent to live together in a committed, exclusive relationship.
  • You and your partner have met in person and know each other personally
  • The applicant meets the health and character requirements.

Who can sponsor for a partner visa?

To be able to sponsor you be 18 years of age and one of the following:

  • Australian Citizen
  • Australian permanent resident
  • Eligible New Zealand citizen.

Is a limit on the number of times a person can sponsor a partner?

There are certain limitations that limits a persons ability to sponsor numerous overseas partners. Several factors need to be considered, please contact us if you have previously sponsored a partner and would like to sponsor a new partner.
