<p>For the Skilled Migration 2021-2022 Program, Tasmania has been allocated a total of 2200 places for Skilled Work Regional (Provisional) visa (subclass 491) and 1100 places for Subclass 190 Permanent Residence ( Skilled Regional) visa.Of the above allocated places, around 500 of those places will be used for applications that got carried forward from the 2020-2021 program. If you wish to migrate to Australia or transition from a temporary visa to a permanent visa then it may be worthwhile for you to see if you qualify for the Skilled Migration Program in Tasmania.</p>
<p>To better understand which subclass gives you a better chance of a successful application, below we have included sections that briefly talks about each of the categories and the eligibility requirement which varies depending on the subclass one is intending to apply for; finally, followed by how to make an application.</p>
<p><b>190 Permanent Residence (Skilled Regional) visa</b></p>
<p>For 190 Permanent Residence ( Skilled Regional) visa, one can only apply under any one of the two streams:</p>
<ul>
<li aria-level="1"><b>Working Stream:</b> This is applicable for anyone who has at least a 6-month work experience in Tasmania prior to applying for the visa. Along with it, the following conditions also need to be met.
<ul>
<li aria-level="2">You must be occupied in any one of the occupations listed on the<a href="https://www.migration.tas.gov.au/skilled_migrants" target="_blank" rel="noopener"> Tasmanian Skilled Occupation List (TSOL)</a>.</li>
<li aria-level="2">To be considered, you need to be employed either on a full time basis with a minimum of 35 hours of work per week; or you may be employed in 2 or more part time jobs.</li>
<li aria-level="2">Both you and your dependents (if any) are required to reside in Tasmania, at the same time you must provide adequate proof that you actually want to continue living there.</li>
<li aria-level="2">The business that employs you needs to be well-established and have a record of successfully operating in Tasmania for at least the last 12 months.</li>
<li aria-level="2">It needs to be shown that there is a true and continuing demand for your position in the business. Therefore, at the time of applying for the nomination you are required to show a 12 month contract and at least there should be 3 months still remaining until the expiration of the contract.</li>
<li aria-level="2">The salary and benefits that you receive should be equivalent to that of the competitive market rates.</li>
</ul>
</li>
</ul>
<ul>
<li aria-level="1"><b>Graduate Stream:  </b>For students who have graduated or will be graduating from a CRICOS registered course in Tasmania can apply under this stream. However, depending on when you have commenced your course the eligibility requirements will vary.</li>
</ul>

<li aria-level="2"><span style="text-decoration: underline;"><i>Commenced before 30 June 2021</i></span></li>
</ul>

<li aria-level="3">It needs to be a full-time course with on-campus participation in Tasmania.</li>

<li aria-level="3">Both you and your dependents (if any) are required to reside in Tasmania, at the same time you must provide adequate proof that you actually want to continue living there.</li>
<li aria-level="3">In cases where you are not currently in any skilled employment, you have to demonstrate how your studies enhanced your ability to find skilled employment in Tasmania. This may include areas unrelated to your study in Tasmania.</li>
</ul>
</li>
</ul>
</li>
<li aria-level="2"><span style="text-decoration: underline;"><i>Commenced after 30 June 2021</i></span>
<ul>
<li aria-level="3">Along with the course being CRICOS registered, it needs to be a minimum of 92 weeks long; and the study basis must be full time with on-campus participation in Tasmania.</li>
<li aria-level="3">Need to have lived in Tasmania for a minimum of 2 years and while you have been studying.</li>
<li aria-level="3">Both you and your dependents (if any) are required to reside in Tasmania, at the same time you must provide adequate proof that you actually want to continue living there.</li>
<li aria-level="3">If you are not currently in any skilled employment, you have to demonstrate how your studies enhanced your ability to find skilled employment in Tasmania. This may include areas unrelated to your study in Tasmania.</li>
<li aria-level="3">If you have had a sydney visa (Subclass 500) while finishing your last course of study in Tasmania, the course needs to be a degree (bachelor, masters or any higher degree), or a diploma (standard, advanced, associate or graduate). Or any qualification related to <a href="https://www.skills.tas.gov.au/about" target="_blank" rel="noopener">Priority Industry Training and Workforce Development Area</a> also counts.</li>
</ul>
</li>
</ul>
</li>
</ul>
<p>If you find that you meet most of the requirements, then you can consider applying for the 190 state nomination. <p><b>Skilled Work Regional (Provisional) visa (subclass 491)</b></p>
<p>The subclass 491 has 6 categories under which one can apply for state nomination. The requirement to fit under any one of these categories are listed below.</p>
<ul>
<li aria-level="1"><b>Working Stream:</b> Same as the requirements discussed above, but there are a few differences which are listed below:
<ul>
<li aria-level="2">You are not required to be working in your nominated occupation.</li>
<li aria-level="2">If your occupation is listed in Tasmanian Skilled Occupations List (TSOL), and you have the appropriate skill assessment then you will be eligible for nomination under this category after three months of employment.</li>
</ul>
</li>
<li aria-level="1"><b>Graduate Stream:</b> Most of the requirements are the same as the ones discussed above in 190 sections.However, the few differences are outlined below:
<ul>
<li aria-level="2">Along with the course being CRICOS registered, it needs to be a minimum of 40 weeks long; and the study basis must be full time with on-campus participation in Tasmania.</li>
<li aria-level="2">Need to have lived in Tasmania for a minimum of 1 years and while you have been studying.</li>
</ul>
</li>
</ul>
<ul>
<li aria-level="1"><b>Overseas Applicants (TSOL) requirements:</b></li>
</ul>
<ul>
<li style="list-style-type: none;">
<ul>
<li aria-level="2">The occupation that you intend to seek nomination under must be listed in the TSOL.</li>
<li aria-level="2">Both you and your dependents (if any) have not resided in another Australian state or territory in the last 12 months.</li>
<li aria-level="2">You have scored the minimum point in your English language proficiency test as per your TSOL occupation.</li>
<li aria-level="2">You have access to sufficient funds to cover the cost of migration and to support yourself and your dependents for at least 6 months while you look for work.</li>
<li aria-level="2">According to TSOL, if your occupation is classified as “High demand”, you are eligible to apply without having to provide any employability evidence.</li>
</ul>
</li>
</ul>
<ul>
<li aria-level="1"><b>Overseas Applicant (Job Offer) requirements:</b></li>
</ul>
<ul>
<li style="list-style-type: none;">
<ul>
<li aria-level="2">You have received a formal job offer for your nominated occupation that is based in Tasmania.</li>
<li aria-level="2">The occupation must be listed on TSOL.</li>
<li aria-level="2">You have scored the minimum point in your English language proficiency test as per your TSOL occupation.</li>
<li aria-level="2">Both you and your dependents (if any) have not resided in another Australian state or territory in the last 12 months.</li>
<li aria-level="2">The business that employs you needs to be well-established and have a record of successfully operating in Tasmania for at least the last 12 months.</li>
<li aria-level="2">The salary and benefits that you receive should be equivalent to that of the competitive market rates.</li>
</ul>
</li>

<li aria-level="1"><b>Family in Tasmania:</b></li>

<li aria-level="2">To be eligible for this stream you need immediate family members who meet the following criteria.

<li aria-level="3">Have held Australian Permanent Residentship or an Australian Citizenship at least 12 months prior to the lodgement of your application.</li>
<li aria-level="3">They have been living in Tasmania for at least 12 months.</li>
<li aria-level="3">They are willing to support you in the process of seeking employment in Tasmania after you have arrived.</li>
</ul>
</li>
</ul>
</li>
</ul>
<ul>
<li aria-level="1"><b>Small Business Owner Requirements: </b></li>
</ul>
<ul>
<li style="list-style-type: none;">
<ul>
<li aria-level="2">In order to be considered for applying under this stream, you need to fulfill the following conditions:
<ul>
<li aria-level="2">Show that you have set up and actively run your solely owned business in Tasmania for a minimum of 6 months.</li>
<li aria-level="2">Show that your business is able to generate you a personal income of at least AUD 53,900 for a minimum of 3 years among the upcoming 5 years.</li>
<li aria-level="2">You need to clearly demonstrate that you have a clear understanding of your responsibilities and requirements towards treating your employees fairly. You do that by finishing the key units on the Fair Work Ombudsman’s <a href="https://www.fairwork.gov.au/tools-and-resources/online-learning-centre" target="_blank" rel="noopener">online learning centre</a>.</li>
</ul>

<p><b>Application Process</b></p>
<p>It must be understood that the application process can be quite complex and includes different sets of documents that need to be supplied at the appropriate time. To help easily understand the process, we have broken down the whole thing into 5 gullible steps.</p>

<li aria-level="1"><b>Check the Eligibility: </b>Of course we can’t stress enough, a huge amount of research and consideration is required on your part to see if you indeed meet the main eligibility requirements outlined by the <a href="https://www.homeaffairs.gov.au/" target="_blank" rel="noopener">Department of Home Affairs</a> for skilled migration.</li>
</ul>
<ul>

<li aria-level="1"><b>Apply for Nomination: </b>You then need to apply for nomination from the Tasmanian Government <a href="https://www.migration.tas.gov.au/skilled_migrants" target="_blank" rel="noopener">website</a>. You must note that the application processing time varies and it may take upto three months to process your application.</li>
</ul>
<ul>
<li aria-level="1"><b>Apply for Visa: </b>If the Tasmanian Government offers you with a nomination, then you will be notified and invited to apply for the appropriate visa via Skillselect. Which means that you are able to apply for your visa through the Department of Home Affairs.</li>
</ul>

<p>The 491 Regional Work Visa – Quick Guide</p>
<p><a href="https://immi.homeaffairs.gov.au/visas/getting-a-visa/visa-listing/temporary-skill-shortage-482" target="_blank" rel="noopener">491 Visa Applications</a> for Tasmania are now OPEN.</p>
<p>The Australian government sets a nomination quota for each state, every year. This means even if you meet the nomination criteria, it is not a guarantee that you will receive the invite.<br />
Since this is a points-based visa, the best way to ensure an invite is to achieve the highest points possible.</p>

<p>There are 3 criteria for onshore applicants and 2 criteria for offshore applicants.</p>
<p>ONSHORE APPLICANTS</p>
<p>CATEGORY 1- TASMANIAN GRADUATE:</p>
<p>The eligibility criteria for this category is as follows:</p>
<p>1. You must graduate from a <a href="https://cricos.education.gov.au/" target="_blank" rel="noopener">CRICOS</a> registered tertiary institution in Tasmania. This means the institute must be registered on CRICOS and must be tertiary.<br />
2. The course you’ve completed/are completing must be 1 of the following:<br />
&#8211; Either a Bachelor or higher degree<br />
&#8211; A diploma<br />
&#8211; Certificate III in Trade qualification (skilled occupation must be listed under Major Group 3 in <a href="https://www.abs.gov.au/anzsco" target="_blank" rel="noopener">ANZSCO</a> )<br />
3. The course duration must be minimum of 1 year (40 weeks)<br />
4. You must be a full-time on-campus student<br />
5. You must have lived in Tasmania for at least 1 year during your period of study<br />
6. You must be “currently” living in Tasmania at the time of lodgement and should be able to provide proof of your ongoing commitment to live in Tasmania.</p>
<p>Once you have all these in place, you can lodge in Expression of Interest for 491 visa.</p>
<p>CATEGORY 2: <a href="https://www.migration.tas.gov.au/skilled_migrants/skilled_regional#" target="_blank" rel="noopener">Working in Tasmania</a></p>
<p>The eligibility criteria for this stream include:</p>
<p>1. EMPLOYMENT IN TASMANIA<br />
You must have been employed in Tasmania for at least 6 months right before you apply for state nomination.</p>
<p>ABOUT EMPLOYMENT:<br />
1.1 The employment does not have to be in your nominated occupation.<br />
1.2. The employment must be at least 35 hours per week in a full-time job or 2 or more part-time jobs.<br />
1.3 You must be able to provide evidence of employment such as payslips, bank statements etc.<br />
1.4 You must fulfill an ongoing skill shortage in Tasmania<br />
1.5 Your employer’s business must be “well-established” and active in operations for at least 12 months in Tasmania.<br />
1.6 If your employment is in a position mentioned in ANZSCO skill level 4 or 5, then your employer MUST provide evidence that no local person was available to fill the job position.<br />

<p>2. LIVING IN TASMANIA<br />
2.1 You and your dependents (if any) must be residing in Tasmania.<br />
2.2. You must be able to provide evidence of genuine commitment that you want to continue living in Tasmania</p>
<p>OFFSHORE APPLICANTS</p>
<p>Category 3A – Overseas applicant (TSOL)</p>
<p>In order to be considered for this category you MUST be living OVERSEAS and fulfill all the below mentioned requirements:</p>
<p>1. Your nominated occupation must be listed in the Tasmanian Occupation List<br />
2. You or any other dependents of yours must have NOT lived in Australia in the past 12 months.<br />
3. You must meet the English requirement specified on the TSOL for your nominated occupation.<br />
4. You must have met the “other requirements and notes” portion in the TSOL of your nominated occupation.<br />
5. Unless your occupation is not a “high demand” occupation in the TSOL, you must provide evidence that there are sufficient employment opportunities (minimum 5 and maximum 8), in your nominated occupation in Tasmania. And that you possess:</p>
<p>5.1) Skill-set and recent work experience relevant to your researched employment opportunity.<br />
5.2) Skills and experience relevant to the Tasmanian economy.</p>
<p>6. If your occupation is listed on the <a href="https://www.seekvisa.com.au/tasmanian-skilled-occupations-list-tsol/" target="_blank" rel="noopener">TSOL</a> as a “high demand” occupation and you meet all the requirements, then providing the employability evidence is not necessary.</p>
<p>7. You must have access to sufficient financial assets to fund your immigration and settlement costs in Tasmania for a minimum of 6 months while you may be seeking employment.</p>
<p>ONLY FOR ENGINEERS:<br />
In order to be eligible for visa state nomination, you must meet the requirements mentioned above and also provide evidence of ONE additional registration or competency as listed on TSOL in your nominated occupation.</p>
<p>CATEGORY 3B- Overseas Applicant (job offer)</p>
<p>If you are OFFSHORE and you’re looking for employment in Tasmania, you must meet the following criteria to be eligible for this category:</p>
<p>1. You must have a formal job offer from a business that’s based in Tasmania AND it must be in your nominated occupation<br />
2. You or your dependents must NOT have lived in any other Australian state or territory in the last 12 months.<br />
3. Your employer’s business must be “well-established” and must have active operations in Tasmania for the last 12 months.<br />
4. There must be a “genuine” need for your particular occupation/ position within the business.<br />

<p>CRITERIA 4 – <a href="https://www.migration.tas.gov.au/skilled_migrants/skilled_regional#" target="_blank" rel="noopener">Family in Tasmania</a></p>
<p>In order to be considered for this category, you must meet all of the following criteria:</p>
<p>1. Your IMMEDIATE family member:</p>
<p>1.1. Must have been an Australian Permanent resident or citizen for at least 12 months, before the lodgement of your application.<br />
1.2. Must be a resident of Tasmania for at least 12 months.<br />
1.3 Must be your: Parent, brother, sister, child, aunt, uncle or grandparent.<br />
1.4 Must agree to support you in Tasmania especially with your employment seeking process.</p>
<p>CRITERIA 5- Small Business Owner:</p>
<p>In order to be considered for this category, you must be living in Tasmania at the time of lodgement of your application and you must fulfill the below-mentioned criteria:</p>
<p>1. You must be able to demonstrate that you have an established business that is in operation in Tasmania for at least 6 months.<br />
2. That must be the “sole owner” of this business<br />
3. You must be able to demonstrate that your business will be able to give you a personal income that will meet or exceed the minimum taxable income requirement ($53,900) per year for at least 3 years.</p>
<p>For this category, all applicants must provide a comprehensive business plan.</p>

<p><strong>MIGRATE TO TASMANIA:<br />
Regional Sponsorship 489 Visa<br />

As migration laws get tougher, obtaining a Permanent Residency in Australia is becoming harder by the day. However certain convenient (but unconventional) pathways are often ignored such as Regional Sponsorship.</p>
<p><strong>PATHWAY TO PR</strong></p>
<p>This is a 2 step pathway program where you transition from a <a href="https://pathmigration.com/visas/skilled-worker-visas/skilled-regional-provisional-subclass-489"><strong>provisional 489 skilled visa</strong></a> to <strong><a href="https://pathmigration.com/visas/skilled-worker-visas/skilled-regional-subclass-887">Permanent Residency 887 Visa</a>.</strong><br />
489 Visa is relatively easier to obtain as it’s provisional (unlike other skilled visas 189/190 which are permanent). However, the 489 visa does automatically transition to PR if all requirements are met.</p>
<p><b>VALIDITY</b></p>
<p>This visa is valid for 2 years with an option to renew for another 2 years (total 4).</p>
<p><strong>WHO IS IT FOR?</strong></p>
<p>Especially beneficial for those who don’t see a clear pathway to PR after their current visa expires. In our experience the <span style="text-decoration: underline;">most common visa category holders</span> who should consider this option are:</p>
<p>1) <a href="https://pathmigration.com/visas/student-visas/student-visa-subclass-500"><strong>Subclass 500</strong>:</a> Student Visa holders who’s occupation is not on the list</p>
<p>2) <a href="https://pathmigration.com/visas/business-sponsor-visas/temporary-business-sponsorship-457-visas"><strong>Subclass 457</strong>:</a> Work Visa holders who’s company sponsorship chances seems bleak.</p>
<p>3)<a href="https://pathmigration.com/visas/skilled-worker-visas/temporary-work-visa-subclass-485" target="_blank" rel="noopener noreferrer"><strong> Subclass 485:</strong> </a>Post-study Work Visa holders who are not working in their designated occupation.</p>
<p>Or any other provisional visa holders who don’t have a clear pathway to Permanent Residency in Australia.</p>
<p><strong>SO WHY TASMANIA?</strong></p>
<p>1) First and foremost – Tasmania doesn’t have an “occupation ceiling.”<br />
2) Secondly – You do not need to work in your “designated occupation.”<br />
3) Last but not the least – The state is open to sponsoring both onshore and offshore applicants.</p>
<p><strong>WHATS THE CATCH?</strong></p>
<p><span style="text-decoration: underline;">1) Residence for 2 years:</span> The applicant MUST have a genuine intention of living and working in Tasmania (or any other Regional area) for the WHOLE DURATION of your provisional skilled visa Subclass 489. <a href="https://pathmigration.com/blog/eligible-postcodes-regional-australia" target="_blank" rel="noopener noreferrer"><strong>See all qualified regional post codes here.</strong></a></p>
<p><span style="text-decoration: underline;">2) Employment for 1 year:</span> Out of the 2-4 years duration of the visa, AT LEAST 1 year full time employment (35 hours per week) has to be demonstrated. The employment does not have to be in your nominated occupation.</p>
